there is no rules ambiguitiy here... break it down a bit: if the contact happens before the tacking boat crosses HtW, then DSQ the port tack boat for failing to keep clear of a stbd tack boat. if the contact happens after the tacking boat crosses HtW, then the boat tacking is a keep-clear...
